Former Athabasca Health Authority CEO wins wrongful dismissal suit

A former chief executive officer of the Athabasca Health Authority (AHA) is awaiting payment from the organization after a successful wrongful dismissal lawsuit.

Allan Adam was hired as the CEO of AHA in March 2021, a position he held until he was terminated in December of that same year. He claims the board turned on him after he fired an individual, who was subsequently rehired as the CEO after Adam was let go.

“I fired this one individual and then the next thing I knew the board met without me,” Adam remarked.

“They did everything under the table type thing. They basically just took over and the next thing I knew, I was fired and the person I fired … became the CEO four days later.”

Upset with the situation, Adam retained legal counsel and filed a statement of claim alleging wrongful dismissal. The AHA failed to file a statement of defense and Adam won a $309,000 judgement by default in June.

The amount covers the lost wages and benefits Adam would have received had he been permitted to finish his contract.

The AHA had until July 31 to pay the settlement, but Adam explained there has been no communication of the board’s intention to do so.

“We gave them the 30-day period after the judgement came down and still no defense on their part,” he noted.

“It was a disappointing time in my life. Almost four years of it has been wasted just on trying to get something good out of it and finally the judgement is in my favour, so I am quite happy.”

When contacted for comment, AHA CEO Roxanne Stuckless issued the following statement:

“Athabasca Health Authority is aware of the judgment obtained by Mr. Adam. Athabasca Health Authority did not have an opportunity to file a statement of defence to Mr. Adam’s claim.

Athabasca Health Authority intends to defend Mr. Adam’s claim, and the matter will be determined by the courts in due course. Athabasca Health Authority will not be providing further comments on the matter while it remains before the courts.”
